While House Republicans in May approved a 10-year moratorium on state AI laws, as part of their version of the One Big Beautiful Bill Act, this moratorium period was stripped out of the bill in a Senate vote early Tuesday.

Sen. Marsha Blackburn (R., Tenn.) in a statement Tuesday said that without federal protections in place, “we can’t block states from standing in the gap to protect vulnerable Americans from harm.”

Last month, Texas moved forward with its own AI regulations, which take effect early next year and include measures aimed at boosting data-privacy protections and other provisions. Other states with AI-specific laws include California, Colorado and Utah, while another 15 states have proposed similar legislation.

Beyond specific laws, numerous states have broad privacy and data security laws that touch some aspect of AI, such as discrimination or automated decision-making, according to Melissa Krasnow, a partner at law firm VLP Law Group.

House lawmakers are anticipated to vote on a final budget bill soon. Any changes would require Senate approval.
