VLP Partner Melissa Krasnow was quoted in the Law360 article “Privacy & Cybersecurity Cases to Watch in 2019.”

The article noted that 2019 is expected to be a big year for privacy and cybersecurity litigation. Two high profile cases on the forefront involve claims that Facebook and Google breached Europe’s new data protection rules and a case before the Illinois Supreme Court has over 100 businesses accused of violating Illinois’ biometric privacy law.

Cases alleging that companies misrepresented their data security posture or covered up breaches in public statements are expected to continue in 2019.

Ms. Krasnow told Law360, “It will be interesting to see which companies, cyber incidents and data security issues will be implicated in the federal securities class action lawsuits that are filed, in light of increasing breach notification, data security and disclosure requirements and greater regulator and government scrutiny.”

She noted that companies need to be careful about how they describe their privacy and cybersecurity practices, whether in an SEC filing or in other public forums like its website or privacy policy. She added that such statements can potentially be used against it by plaintiffs’ counsel.
