VLP Partner Melissa Krasnow was quoted in the Law360 article “Cybersecurity & Privacy Predictions For 2018.”
The article reported that the biggest privacy and cybersecurity issues from the past year will continue to grow in prominence in 2018. The publication noted that attorneys are predicting a further expansion of an already complex data breach landscape, greater attention being paid to internet-connected devices, and more additions to a vast global patchwork of laws.
Ms. Krasnow was one of several cybersecurity and privacy attorneys asked by Law360 to identify some major trends and offer predictions for what practitioners should expect to hear from their clients in the coming year.
The article noted that 2017 was a year marked by global ransomware attacks and massive data breaches that temporarily took down major businesses. According to attorneys interviewed, the cyber threat environment is expected to keep growing and evolving in the new year as companies continue to contend with the influx of consumer and shareholder class actions that typically follow such high-profile incidents.
Ms. Krasnow said, “Boards of directors will continue to be interested in hearing about privacy and data security developments as well as developments involving emerging technology, artificial intelligence and big data.”
The article also reported that one of the most important events of 2018 will be the implementation of the European Union’s General Data Protection Regulation (GDPR) in May. The GDPR brings with it a new requirement for companies to disclose data breaches within 72 hours — most U.S. laws require notification as soon as possible, with the handful of states that do set a specific time period going no lower than 30 days. Ms. Krasnow noted that Canada is also expected to implement mandatory federal breach notification regulations in 2018.
